These Terms of Service ("Terms") form an agreement between 365 DELIVERY LLC ("we," "us," "365 DELIVERY") and you ("Customer") when you book or pay for any service through this website. Read these Terms in full before paying a deposit; paying a deposit means you accept them.
1. Services we provide directly
365 DELIVERY directly performs:
- Intra-city helper moves (single-city moves anywhere in Los Angeles County)
- Last-mile delivery of large items within Los Angeles County
- Junk removal and cleanup
- Single-item specialty transport (piano, safe, art, fish tank, and similar)
These services do not require a California Public Utilities Commission CAL-T# permit because they are not intrastate "for-hire household goods" moves under California PUC General Order 142.
2. Partner Network — long-distance and intrastate California moves
Intrastate moves within California (city-to-city, such as Los Angeles to San Diego, the Bay Area, Sacramento, or anywhere outside Los Angeles County) require a CAL-T# permit. 365 DELIVERY LLC does not currently hold a CAL-T# permit. Until our permit is issued, every intrastate move is fulfilled by an independent CAL-T# licensed partner carrier.
When you book a "Partner Network" service:
- 365 DELIVERY is the booking agent and your single point of contact for coordination, billing, and customer support.
- The actual transport is performed by a third-party carrier that holds an active CAL-T# permit issued by the California Public Utilities Commission.
- The partner carrier's CAL-T# number is disclosed in writing on your booking confirmation.
- The partner carrier's tariff governs cargo liability for the transport leg; 365 DELIVERY does not assume cargo liability beyond what the partner carrier provides.
If you require a direct (non-partner) intrastate move, you must book with a CAL-T#-licensed carrier directly.
3. Booking, deposits, and balance
- For instant flat-price packages and calculator quotes under $5,000, the deposit is 20% of the total, charged at booking.
- For range estimates between $5,000 and $15,000, the lock-in deposit is 15% of the midpoint, charged at booking; the final total is confirmed in writing by phone or email before the move.
- For consultation jobs (over $15,000 or Partner Network), no deposit is collected until a written estimate is mutually accepted.
- The balance is due immediately upon completion of the work, via a secure Stripe-hosted payment link sent to your email.
All amounts are quoted and charged in United States dollars (USD). Stripe Inc. processes all payments; we do not store your full payment-card data.
4. Surcharge schedule (the "no-surprise" guarantee, in writing)
If you accurately disclose the job conditions at booking, the quoted or calculated price is locked. If we discover on-site any condition you did not disclose, we apply the posted surcharge below, in writing, before work begins:

We will never quote you a surcharge that is not on this list and not in your booking confirmation.
5. Cancellations and rescheduling
- More than 24 hours before the move: free cancellation, full deposit refund. Free rescheduling.
- Less than 24 hours before the move: deposit is non-refundable. You may reschedule once at no additional charge subject to crew availability.
- No-show: deposit is forfeited and a $150 crew-dispatch fee may apply.
- Cancellation by us: if we fail to send a crew on the booked date for reasons within our control, we refund your full deposit within five (5) business days and credit you a 10% discount on any future booking.

6. Customer obligations
You agree to:
- Disclose all job conditions truthfully — including home size, stairs, long-carry distance, parking access, specialty items, and building requirements (COI, elevator booking, parking permits).
- Have the pickup and drop-off addresses accessible at the booked time.
- Be present (or have an authorized adult present) at both ends of the move.
- Not require us to transport prohibited items (see §7).
- Pay the balance promptly via the link emailed after the move.
If you fail to meet these obligations, we may apply the relevant surcharges from §4, reschedule the work, or, in severe cases, terminate the engagement and retain the deposit.
7. Items we will not transport
We will refuse to load:
- Hazardous materials: paint, fuel, propane, chemicals, ammunition, batteries.
- Biohazard or medical waste.
- Live animals (other than fish, by special arrangement).
- Illegal substances or contraband.
- Cash, jewelry, irreplaceable documents — we ask you to carry these yourself.
- Anything we reasonably believe to be unsafe for our crew or our truck.
If we discover such items mid-load, we will pause the work and request your direction. Work time during such pauses is billable at our standard hourly rate.
8. Insurance
Every move includes federal-standard basic carrier protection at $0.60 per pound per article. This is the legal minimum for licensed movers and is not equivalent to full replacement value.
Full-value protection is available as an optional upgrade at checkout. If selected, damaged or lost items will be repaired, replaced, or reimbursed at current market value, subject to a clearly disclosed deductible.
Carrier and policy details are listed on every booking confirmation and are available on request: insurance details available on request at the time of writing; carrier and policy number will be published on the Insurance page once the public-facing summary is finalized.
Items packed by the customer (PBO — "packed by owner") are covered only for visible external damage to the carton, not for contents.
9. Liability limits
To the maximum extent permitted by law:
- Our aggregate liability for any claim arising from a move is limited to the lesser of (a) the amount paid for the move or (b) the limits of the protection level you selected (basic or full-value).
- We are not liable for indirect, incidental, special, or consequential damages.
- We are not liable for delays caused by traffic, weather, building access restrictions, or other circumstances outside our reasonable control.
- For Partner Network moves, cargo liability is governed by the partner carrier's tariff and any additional insurance you elect through that carrier. 365 DELIVERY's liability for partner-fulfilled moves is limited to the coordination fee component, not the transport.
10. Dispute resolution

If we cannot resolve a dispute informally within 30 days:
- For moves we performed directly: the dispute is governed by the laws of the State of California and venue lies in the state or federal courts located in Los Angeles County. The parties may, by mutual written agreement, submit the dispute to binding arbitration through JAMS in Los Angeles.
- For Partner Network moves involving the partner carrier as the transporter, you may also file a complaint with the California Public Utilities Commission Consumer Affairs Branch and reference the partner carrier's CAL-T# (printed on your booking confirmation).
- Customers retain all non-waivable rights under the California Consumer Legal Remedies Act and the Federal Trade Commission's regulations on household goods carriers (49 C.F.R. Part 375), where applicable.
Nothing in these Terms waives your right to file a small-claims action.
11. Photographs and recordings
Crews may photograph high-value items, pre-existing damage, and the loaded truck as part of our standard documentation. These photos are stored securely and used only for claims processing and internal quality control. You may opt out by emailing 365deliveryin@gmail.com before the move.
We do not record audio or video of the inside of your home.
12. Marketing and reviews
After your move we may email you a review request. Replying is optional. We do not pay for or solicit fake reviews. Reviews we collect are published only with your permission and the platform's terms.
13. Modification
We may update these Terms from time to time. Material changes will be announced on the website with a new effective date. Continued use of our services after a Terms update means you accept the new version. The Terms in force for any given booking are those displayed on the website at the time you paid the deposit; the version is archived with the booking record.
14. Severability
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force.
